TERMS AND CONDITION
General conditions of use of the portal
This general condition applies to all users who visit and/or carry out any commercial transaction through the WOSLER portal.
The domain “wosler.eu” (WOSLER), its brand, content, and logos are the property of SMART HEALTH DIGITAL APP SL, hereinafter WOSLER, with registered address at Calle Alhóndiga, 6, 5ºC, CP 18001 of Granada, with C.I.F nº B-67.918.151 registered in the Mercantile Registry of Granada, Volume 1860, Folio 25, Sheet GR-60.543, with the express exclusion of content that, appearing on the portal, belongs to third parties.
Conditions of use of the portal:
- WOSLER is an internet portal that allows users to request ambulance, assistance and/or other similar medical services (hereinafter, “the services”) as described in the portal’s terms of service.
- The user can access the reading of the “terms and conditions” of each service before contracting them.
- “User” means any person who visits, contracts, or accesses the contents of the “WOSLER” Internet portal.
- “The portal or platform” will be understood as the set of pages that make up the “WOSLER” Internet site, excluding any other that is not located under the aforementioned domains.
- The user, by visiting, accessing, or registering, declares that they have read, understood, and fully accept these general conditions, the privacy and cookie policy, and any legal texts published on the website.
- If the user has not read, does not understand, or does not accept these general conditions, they should not use the portal or contract any service.
- WOSLER is free, without prior notice, to change, alter, eliminate, or modify any content of the portal, including the general conditions and the payment service conditions. Therefore, each time the user visits, uses, or carries out any commercial transaction through the portal, they are subject to the regime provided for in the terms of service, where applicable.
- Any change in these general conditions or in the payment service conditions will take effect from its publication on the portal.
- The user, by the mere use of the portal, is responsible for such use, responsibility that the user accepts extended in the event that it is necessary to register to use certain content or services.
- In case of registration, the user is responsible for providing truthful data and acting within the law and in good faith regarding the data that is required of them. Likewise, the user is responsible, from registration, for the use of their user account, their password, and their access code, committing to making legal, diligent, and confidential use of all of it.
- Access to the portal should only be made by legally capable persons with full capacity to contract according to the common Spanish legislation in force at all times (over eighteen years of age).
- The user who makes any suggestion, requested or not, whether it is an improvement or not, about (without limitation): new ideas, new promotions, improvements on the catalog of services or products, other material apart from the content on the portal, advertising forms, marketing policy or system, sales policy or system; assigns to the owner of WOSLER, by the mere fact of making such a suggestion, the full availability of rights over such suggestion and its consequences, products, or derivations, free of charge, full, unlimited in time and place, and irrevocable.
- The owner of WOSLER is also the owner of the content inherent to the portal (logo, brand, etc.), excluding those corresponding to the owners of the products or services offered, whose ownership is held in each case by its owner.
- The user assumes their sole responsibility, expressly exempting WOSLER and its owner, for the handling and configuration of their personal computer, their software, their telephone lines, their Internet access services, etc., that the user uses for their access to the portal. Under the same conditions, the user assumes their sole responsibility for the prevention of computer viruses, Trojans, worms, and/or any other destructive or corrupt software. Likewise, the user assumes their sole responsibility for the partial or complete maintenance of a copy of the contents of the portal on their personal computer, with no offer, data, or information not located on the server where the portal is located being binding on WOSLER.
- WOSLER reserves the right to deny or withdraw access to the portal and/or the products or services offered without prior notice, at its own request or that of a third party, to those users who fail to comply with these General Conditions.
- The inclusion by a third party, on any web page, of a link leading to the WOSLER portal will necessarily require the request for such inclusion, in writing, to WOSLER and written permission from it, being considered NOT allowed until obtaining the express consent of the owner of WOSLER.
- The user allows WOSLER to use their cookies (a file implanted on the user’s devices by the Internet site they entered and that contains information about the user) and WOSLER undertakes to use them diligently and exclusively in the interest of the user and to improve the services offered. - WOSLER does not have final control over the links that could be inserted in the portal, so it does not assume any responsibility for the technical availability, quality, reliability, accuracy, veracity, legality, or validity of any material or information contained in any of these links external to the portal.
- These General Conditions are governed by common Spanish law. The parties submit, at their election, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user’s domicile, in the event that they are a natural person. In the case of being a legal entity, it will be submitted to the Courts of Granada Capital.
