TERMS AND CONDITIONS OF THE PORTAL
1. General Information
In compliance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), it is hereby stated that the domain www.wosler.eu (hereinafter, the “Portal”) is the property of SMART HEALTH DIGITAL APP S.L., a company registered with the Commercial Registry of Granada, Volume 1860, Folio 25, Sheet GR-60.543, with registered office at C/ Alhóndiga, 6, 5ºC, CP 18001, Granada (Spain), and VAT number B67918151 (hereinafter, “WOSLER”).

2. Purpose of the Portal
The Portal aims to provide information about the digital medical assistance service, which allows users to access remote consultations with licensed healthcare professionals by directly contracting the service through a payment gateway.
WOSLER does not provide medical services. Its role is solely to act as a technical and operational intermediary, facilitating user access to duly licensed and qualified independent medical professionals. Under no circumstances shall it be understood that WOSLER is part of the doctor–patient relationship or that it provides any diagnosis, treatment, or clinical advice.
3. Acceptance of Terms
Browsing, accessing, or using the Portal implies the express and unreserved acceptance of all terms set forth herein, as well as the privacy and cookies policy available on the website. The user declares that they have read, understood, and fully accepted these conditions and agrees to act in accordance with the law, good faith, morality, and public order.
Any person who does not accept these terms must refrain from using the Portal or contracting any services available through it.
4. Portal Access and Legal Capacity
Access to the Portal is limited to persons of legal age with full legal capacity under Spanish law. The user declares to be at least 18 years old. Although the digital medical assistance service may be aimed at individuals over 16, only users of legal age may contract the service.
5. Contracting the Digital Medical Service
The digital medical assistance service is contracted through a one-time payment via the integrated payment gateway on the Portal. Upon payment confirmation, the user automatically accepts the terms and conditions of both the Portal and the digital medical assistance service, which are available for consultation on the website prior to payment.
WOSLER receives an automatic notification from Stripe in the event of a successful payment. If the payment is declined or not completed correctly, the user is not entitled to receive the service.
Contracting the service does not entail the creation of a user account or profile on the Portal. The service is one-time use and does not require prior registration.
6. Data Storage
The only personal data collected through the Portal are those strictly necessary to issue the corresponding invoice for the service payment (such as name and email address). These data are collected and stored by the payment gateway solely for that purpose. WOSLER does not create medical records or store health-related information. All medical information is the responsibility of the attending physician, who is not an employee of WOSLER and does not have an employment relationship with the company.
7. Nature of the Service and Disclaimer of Medical Responsibility
WOSLER’s role is to provide users with access to independent licensed doctors who can offer remote medical care. WOSLER does not provide medical advice nor participates in any phase of the medical act. The professionals attend to the user autonomously, based on their own clinical judgment and under their legal responsibility as licensed physicians.
WOSLER shall not be held directly or indirectly liable for the outcomes of the medical care, the diagnoses issued, prescriptions provided, or any consequences arising from the medical act. Any dispute, complaint, or claim must be addressed directly to the healthcare professional who provided the service.
8. Technical and Legal Limitations
WOSLER does not guarantee uninterrupted access to the Portal or the absence of errors. It shall not be held responsible for technical problems resulting from the use of the Portal, including viruses, network interruptions, server failures, or any other incident beyond its reasonable control.
The use of VPNs or other means to conceal or alter geographical location in order to access the service from jurisdictions where it is not permitted is strictly prohibited. The user shall be fully responsible for any regulatory breach resulting from such actions.
9. Payment Processing Responsibility
The payment for the service is processed through an external gateway managed by Stripe, a secure and certified platform. WOSLER never has access to the user’s full card details and does not store any sensitive financial information.
WOSLER shall not be held liable for technical failures, payment rejections, service interruptions, duplications, processing errors, or any other incident attributable to the payment gateway. In the event of a payment error, the user must contact Stripe or their card issuer directly to resolve the issue.
If the payment is not completed correctly, the user shall not have the right to access the digital medical service, even if they receive confirmation by other means. Only payments confirmed by Stripe via electronic notification to WOSLER grant the right to receive the service.
10. Third-Party Links
The Portal may contain links to external websites that are not operated by WOSLER. WOSLER exercises no control over such sites and is not responsible for their content, legality, or technical availability. The inclusion of links does not imply any affiliation or recommendation by WOSLER.
11. Intellectual Property
All content on the Portal, including text, images, logos, software, graphic design, color schemes, and navigation structure, is the property of WOSLER or its respective rights holders. Any reproduction, distribution, or public communication without express written authorization from the rights holder is strictly prohibited.
12. Jurisdiction and Applicable Law
These terms are governed by common Spanish law.
If the user is a natural person, any disputes shall be resolved by the courts of the user’s place of residence.
If the user is a legal entity, the parties expressly submit to the Courts of Granada (Spain), waiving any other jurisdiction that may apply.

1. Información general
En cumplimiento de la Ley 34/2002 de Servicios de la Sociedad de la Información y del Comercio Electrónico (LSSI-CE), se informa que el dominio www.wosler.eu (en adelante, el “Portal”) es propiedad de SMART HEALTH DIGITAL APP S.L., sociedad inscrita en el Registro Mercantil de Granada, Tomo 1860, Folio 25, Hoja GR-60.543, con domicilio social en C/ Alhóndiga, 6, 5ºC, CP 18001, Granada (España), y CIF B67918151 (en adelante, “WOSLER”).

2. Objeto del Portal
El Portal tiene como finalidad brindar información sobre el servicio de asistencia médica digital que permite a los usuarios acceder a una consulta médica a distancia con un profesional sanitario colegiado, mediante la contratación directa del servicio a través de una pasarela de pago.
WOSLER no presta servicios médicos. Su función es exclusivamente la de actuar como intermediario técnico y operativo, facilitando el acceso de los usuarios a médicos colegiados independientes, debidamente acreditados y habilitados para ejercer conforme a la normativa vigente. En ningún caso se entenderá que WOSLER forma parte de la relación médico-paciente ni que presta diagnóstico, tratamiento ni orientación clínica alguna.
3. Aceptación de condiciones
La navegación, acceso o utilización del Portal implica la aceptación expresa y sin reservas de todos los términos aquí descritos, así como de la política de privacidad y cookies disponible en el sitio web. El usuario declara haber leído, comprendido y aceptado íntegramente estas condiciones, y se obliga a actuar conforme a la ley, la buena fe, la moral y el orden público.
Cualquier persona que no acepte estas condiciones deberá abstenerse de utilizar el Portal o de contratar cualquier servicio disponible en él.
4. Acceso al Portal y capacidad legal
El acceso al Portal está limitado a personas mayores de edad con plena capacidad jurídica conforme a la legislación española. El usuario declara tener al menos 18 años. Si bien el servicio de asistencia médica digital puede estar dirigido a personas mayores de 16 años, la contratación sólo podrá realizarse por personas mayores de edad.
5. Contratación del servicio médico digital
La contratación del servicio de asistencia médica digital se realiza mediante un único pago a través de la pasarela de pago integrada en el Portal. Una vez confirmado el pago, el usuario acepta automáticamente los términos y condiciones tanto del Portal como del servicio de asistencia médica digital, disponibles para su consulta en la web antes de efectuar el pago.
WOSLER recibe notificación automática por correo electrónico desde Stripe en caso de pago exitoso. Si el pago es rechazado o no se completa correctamente, el usuario no tiene derecho a la prestación del servicio.
La contratación no implica la creación de un usuario o cuenta personal en el Portal. El servicio es de uso puntual y no requiere registro previo.
6. Almacenamiento de datos
Los únicos datos personales recogidos a través del Portal son aquellos estrictamente necesarios para emitir la factura correspondiente al pago del servicio (como nombre y correo electrónico). Estos datos se recogen y almacenan en la pasarela de pago, únicamente con esa finalidad .WOSLER no crea historiales clínicos ni conserva información médica. Toda información relacionada con la atención médica es responsabilidad del profesional que atienda al paciente, quien no forma parte de la plantilla de WOSLER ni mantiene relación laboral con la empresa.
7. Naturaleza del servicio y exclusión de responsabilidad médica
La función de WOSLER es poner a disposición del usuario un canal de acceso a médicos colegiados independientes que puedan prestar asistencia médica remota. WOSLER no proporciona asesoramiento médico ni participa en el acto médico en ninguna de sus fases. Los profesionales que atienden al usuario lo hacen de forma autónoma, bajo su propio criterio clínico y conforme a su responsabilidad legal como médicos colegiados.
WOSLER no será responsable, directa ni indirectamente, por los resultados de la atención médica, los diagnósticos emitidos, las recetas proporcionadas o cualquier consecuencia derivada del acto médico. Cualquier discrepancia, queja o reclamación deberá dirigirse al profesional que prestó el servicio.
8. Limitaciones técnicas y legales
WOSLER no garantiza el acceso ininterrumpido al Portal ni la ausencia de errores. Tampoco se hace responsable de problemas técnicos derivados del uso del Portal, incluidos virus, interrupciones en la red, fallos de servidor o cualquier otro incidente ajeno a su control razonable.
Queda prohibido el uso de VPN u otros medios para ocultar o alterar la ubicación geográfica con el fin de acceder al servicio desde jurisdicciones donde el mismo no esté permitido. El usuario será plenamente responsable de cualquier incumplimiento normativo derivado de esta práctica.
9.Responsabilidad sobre el procesamiento del pago
El procesamiento del pago del servicio se realiza a través de una pasarela de pago externa gestionada por Stripe, una plataforma segura y certificada. WOSLER no tiene acceso en ningún momento a los datos completos de la tarjeta bancaria del usuario, ni almacena información financiera sensible.
WOSLER no se hace responsable por fallos técnicos, rechazos, interrupciones del servicio, duplicidades, errores de procesamiento o cualquier otra incidencia atribuible a la pasarela de pago. En caso de error durante el proceso de pago, el usuario deberá contactar directamente con Stripe o con su entidad emisora de tarjeta para resolver la situación.
Si el pago no se completa correctamente, el usuario no tendrá derecho a acceder al servicio médico digital, aun cuando haya recibido confirmación por otros medios. Solo los pagos confirmados por Stripe mediante notificación electrónica a WOSLER habilitan el derecho a la prestación del servicio.
10. Enlaces a terceros
El Portal puede contener enlaces a páginas externas que no son operadas por WOSLER. WOSLER no ejerce control alguno sobre dichos sitios ni se responsabiliza por su contenido, legalidad o disponibilidad técnica. La inclusión de enlaces no implica asociación ni recomendación por parte de WOSLER.
11. Propiedad intelectual
Todos los contenidos del Portal, incluyendo textos, imágenes, logos, software, diseño gráfico, combinaciones de colores y estructura de navegación, son titularidad de WOSLER o de sus respectivos propietarios. Queda estrictamente prohibida su reproducción, distribución o comunicación pública sin autorización expresa por escrito del titular de los derechos.
12. Jurisdicción y ley aplicable
Estas condiciones se rigen por la legislación común española.
En caso de que el usuario sea persona física, cualquier controversia será resuelta por los juzgados y tribunales del domicilio del usuario.
En caso de que el usuario sea persona jurídica, las partes se someten expresamente a los Juzgados y Tribunales de Granada capital, con renuncia a cualquier otro fuero que pudiera corresponderles.
